Guys.. Help me..
Im livin in Seattle wa and I recently(may 27th) got into the accident.
The other driver was at fault, and every progress seemed going well.
But my insurance company(amfam) told me that they couldnt find the other driver's info on his insurance comp(progressive).
So I called to progressive and heard the other driver didn't even open the claim till now, so I opened it myself..
However, i just received the phonecall from them that he had no insurance at all, but at the police report, his insurance's expiration date was aug 28th.
So I'm assuming that after he got a insurance card, he just canceled the insurance.. I dunno what should I do.. Damn help me
 
If you have Uninsured Motorist protection included in your policy then you're all good, if not you'll have to pay your deductible (assuming you have comp. and coll. coverage) and your insurance will fix your car, then take the other party to a small claims court to get your deductible back.

Ive already got paid about my previous vehicle cuz it got totaled, so I bought another treg xD. However.. since he got no insurance, just wondering, should I sue him to get paid? Because I need to pay my medical bills since my UM coverage is only 1000 bucks as my insurance company said.. They said they are not the 1st medical so.. Those are not affordable amount cuz I and my insurance comp thought he was insured...
I dunno what should I do.. This is confusing.
 
Talk to an attorney AND get in touch with the Washington State insurance commission office to report the other driver for violating the insurance laws. Also file a formal complaint with the State motor vehicles division and the police jurisdiction which visited the accident site and filed their report. It is up to them to decide on any criminal action they might want to take.
If they DO decide to take action it will strongly support any civil case you may decide to bring.

But there are no tough punishment from that reporting to the state insurance commissioners right..? Then I might go to PD and file a formal complaint as you said.. May I ask you the name of the paper work? Thank you so much.

They told me there's nothing I can do with individually, all I could do is file a complaint against the insurance company, in this case, progressive. Damn.. What can I do?
This motherf driver ruined many ppl's life.. Me and his passengers.. Hue
 
As long as he is at fault, the suing part is up to your insurance company. Sure, you could hire an ambulance chaser to go after the guy and whatever assets he has, but you'd be giving up 40-50% of whatever they are able to recover, plus all the time it will take. Unless the dude is loaded (doubt it), forget about it and move on. That's why you have insurance and pay your bills. An accident like that where you aren't at fault will not affect your insurance rates.

You could go back to the police and let them know his insurance was expired / cancelled and they could give him a ticket for it.

Sorry man - that's terrible news.

Yeaa.. Lol so sad that there's nothing I can do right now but talkin with my attorney. I didn't even hired one yet, but i do hav an appointment on sunday with my friend who is attorney. I'm pretty panic and curious that am I the only one that being too nervoused and frustrated on this situation xD.. Now everytime I see the red eclipse, i'm getting fringe.

The report to the insurance commissioner is so that they can take any action THEY deem necessary against the driver who has violated the insurance rules THEY have set - not to push your claim against the perp. If they do not have a process for making the report then you should have a chat with your State representative. The question HE should be asking is why is it that an insurance commission can set rules for insurance coverage etc and NOT have a way of enforcing same rules.
And no, I do not have any idea which forms are appropriate for your use in reporting to the commission.

Alrightyy.. Thank you for your help. I will go contact with them again and contact wih police who went to the scene, and report what had been going right now.. And definitely yes I'm going to hire my attorney who is the friendnof mine. Thank you so muh for your help!
