Why?

Why would anyone want to participate in such a thing? Most (all?) states have consumer protection statutes. If the manufacturer can't make the car conform to the warranty within a reasonable amount of time or number of attempts, the compensation available to the consumer is far better than what could be obtained through a class action.

Individual lemon law claims, claims in arbitration or lawsuits lead to reasonable compensation or restitution for the conusmer. Class actions lead to windfall compensation for attorneys and pennies for the class members.
 
Not that VW doesn't deserve to be sued over a number of things in the Touareg, such as headlight wiring disintegration..
 
Yup, that's it. Just got a letter from the class. You get a free repair, consisting of removing one drain valve on the intake (doesn't specify which one) and an airfilter if yours is damaged. Also get 75% of the verified costs to repair/replace your engine due to water ingestion damage, if done at a VW or qualified shop.

Well Hot Dayum! They had to be sued to address this issue. Still, public denial of a design defect and being able to maintain that falsehood under the cover of a settlement is still an admission of guilt IMO. But good for two T reg owners for taking VWoA to court over this. (Curious if they are members of Club T) 😄
