I am closing this thread until I have time to speak with an attorney about this. I wish it was as simple as applying for the club/enthusiast license but in a quick review I see some red flags. Club Touareg is owned by a small business (Social Knowledge, LLC) so we are not a non-commercial site (disqualifies us for a license) and secondly it appears we would have to give them our domain name if/when the license were to expire:
A) Domain Name:
As a general rule, an Enthusiast or Club, after obtaining a license from VWGoA, will be granted limited permission to use no more than two Volkswagen trademarks in a single domain name (i.e., JOESVWBEETLECLUB.COM has two Volkswagen trademarks), and in a single domain name or url (i.e., a club may have only one domain name or url, not more than one). Each domain name must be approved by VWGoA before a license will be granted to use that domain name. If you currently are the registrant of a domain name that is acceptable to VWGoA's enthusiast program, you hereby agree to transfer the name to VWGoA's domain name registry after the license agreement has been terminated. If the registration of a new domain name is required, you agree to register the name through with VWGoA as the registrant of the domain name through VWGoA's registrar, IP Protector, or any other registrar that VWGoA may designate in the future.
Since this issue is more complex then just making t-shirts I am asking you all to put this on hold and wait for me to get some legal advice.
