And this car is definitely outside of extended emissions warranty?
 
Usually extended warranties cover most items barring the usual wear items. How are they able to weasel out of covering the repair? What does your extended warranty agreement say as far as items that are covered?
 
I have a separate extended warranty
I get that you have a junky aftermarket warranty. But, are you 100% sure the factory (worthwhile...) warranty is out?

The contract does state they should cover an item like this. What the rep said was that they would send someone out after the motor/tranny are out of the car and as long as it is determined that the failure wasn’t caused by a lack of maintenance issue such as a missed oil change they should cover it. The should part of this is where I have a concern. I don’t want to spent $11K on this car. I have receipts for the oil filters and oil I have purchased for the Touareg but I do my own maintenance and if they determine that only having a parts receipt is not enough I may be screwed.

Usually warranties have stipulations (like proving x,y,z maintenance was conducted). Tire companies do the same thing. In order for those beefy AT's to live up to their 60k mile tread warranty, you have to prove rotations every 5k miles. Same thing w/ some auto warranties.

Back in the day we used to be able to write the date on the oil filter when we changed them. Can't do that anymore.
I know it's going to be tough to convince them you did the service but you have the receipts, what would they think you were buying all the oil/filters for?
 
I have likely the same symptoms on my ‘09, still sitting at the dealer waiting on parts for full engine replacement after 6mo, under the VW warranty.

Regardless of the warranty terms they can’t void it for oil changes legally in the USA unless they can prove neglect actually caused the failure.

It’s likely you will need to just have the work done, and negotiate and/or sue the insurance company for possible reimbursement- as it will likely take a year or more to get the money if they’re being awful about it. You could realistically be looking at 1 year to get approval, and a second year to get parts… just be prepared.

I wouldn’t deal with a company that wastes my time on the phone like that. Tell them you are logging your hours and expect reimbursement for your time also- at consulting rates. This isn’t an empty request because if you sue you could likely get that.

Thanks for your insight. I do keep a log of maintenance with all my cars but I don’t do so well at keeping receipts from my local parts store for oil and filters. I try with important parts like starters or alternators as I usually buy ones with warranty’s. The dealer is the one that is being pushy right now. They want their loaner back and a signed authorization that says we will pay if the rep says no. How can they claim that there was a lack of maintenance by looking at the timing chain? Do they analyze the oil or something or is it totally based on my records?looking into a crate engine at this point. Has to be cheaper than $11K and I walk away with a new engine not just a timing chain.
 
Lack of maintenance based on the timing chain? I dont think so. Unless lack of oil changes or improper oil type was used. Which exact oil have you been putting into it?

Castrol Edge extended performance 5-30 is what I was instructed to use. I was planning on using Mobil 1 synthetic when I bought the car but Castrol came up several times in different searches I did.

I’m really not comfortable taking the gamble of being stuck with an $11K bill when I know there are other alternatives. But the other side of the coin is that the idea of pulling the car out of the dealer on a trailer and starting the process almost from scratch is not something I’m looking forward to either. We bought the extended warranty for peace of mind and now it’s turning out to be a serious stressor to say the least.

Unfortunately, 3rd party warranties are always a scam- even on houses, electronics, etc. They're written by lawyers to make it so that nobody in the real world will ever meet the conditions where they actually pay out- and unless you are unemployed, the time fighting them to make them pay will be worth way more than the value they pay out. Even the effort and expense to follow the rules to the letter so the warranty isn't voided, will cost more than the payout is worth.

I get a chuckle out of how department stores now offer 3rd party warranties at checkout on almost anything... I'm pretty sure I had to decline a 10 year extended warranty offer on a $1 pack of disposable coffee filters. After you decline that, they ask if you want to sign up for a credit card with 30% interest.

Well the oil is proper vw-spec anyhow so thats huge. What oil filters?

Funny you mention that. I just ordered some shrink tubing on Ebay for $9.99. They offered a 3 year warranty for $4.99 more.... on shrink tubing. :LOL:
